Terms and Conditions
By using BoilerVault’s Services, the Customer acknowledges that they have read, understood, and agreed to these Terms and Conditions. These Terms and Conditions constitute the entire agreement between the Customer and BoilerVault and supersede all prior agreements, understandings, or representations.
Definitions:
BoilerVault: Refers to the company providing storage and retrieval services under these Terms and Conditions.
Customer: Any individual or entity that utilizes BoilerVault’s services for storing and retrieving personal belongings.
Drop-Off Date: The scheduled date on which stored items are returned to the Customer.
Pick-Up Date: The date on which the Customer’s items are collected for storage.
The standard storage period is four (4) months, beginning on the date the items are received by BoilerVault and ending on the scheduled drop-off date. Customers retrieving items before the scheduled drop-off date will still be responsible for the full storage fee for the entire four-month period. BoilerVault does not offer prorated refunds for early retrieval. If storage is required beyond the initial four-month period, the Customer must contact a BoilerVault representative to arrange an extension. Additional fees will apply. If the Customer requests retrieval of items before the scheduled drop-off time, their original storage payment remains unchanged. BoilerVault reserves the right to take up to seven (7) days to retrieve requested items. Early retrieval is subject to availability and logistical constraints. The Customer must provide at least 48 hours’ notice for early retrieval requests. BoilerVault may refuse such requests if they cannot be accommodated.
The Customer must be present at the scheduled pickup or drop-off time and location. Failure to be present for 2 scheduled times will result in a 15% fee applied to their order to compensate BoilerVault for the additional time and resources required to reschedule the service. The Customer is responsible for contacting BoilerVault to arrange a new pickup or drop-off time. Failure to reschedule within a reasonable timeframe may result in additional fees or forfeiture of stored items. BoilerVault reserves the right to refuse service if the Customer repeatedly fails to be present during scheduled time.
The Customer is required to provide a drop-off time and location for their personal belongings by September 15th. If they fail to do so, the items will automatically become the property of BoilerVault. The Customer may reclaim ownership of their items by paying a $200 fee, which must be paid in full before the items are released by October 5th. BoilerVault reserves the right to dispose of or sell any unclaimed items after the deadline. The Customer waives all compensation for such items and is solely responsible for providing the necessary information on time. BoilerVault is not responsible for notifying the Customer of the impending deadline.
BoilerVault is not responsible for any damage to stored items caused by natural disasters, including but not limited to floods, earthquakes, or severe weather events. BoilerVault is also not liable for damage resulting from fire, explosions, pest infestations, normal wear and tear, or improper storage by the Customer. The Customer agrees to inspect all items upon delivery and report any visible damage to a BoilerVault representative immediately. Failure to report damage at the time of delivery will result in the waiver of any claims. BoilerVault’s insurance coverage is limited to visibly apparent exterior damage to stored items. The Customer acknowledges that BoilerVault does not cover damage to improperly packed items or concealed damage. If extensive damages originate from a Customer’s item, the Customer will be held responsible for all related damages. The Customer agrees to first claim any loss against any insurance carried by themselves or their parents or legal guardian, if available. BoilerVault’s liability is limited to $120 per item and $600 total for all stored items.
The Customer agrees not to store prohibited items, including but not limited to liquids, illegal substances, plants, animals (live or deceased), firearms, explosives, flammable materials, or food items. If prohibited items are found, BoilerVault will report them to the appropriate authorities, and the Customer will be responsible for any resulting fines or legal consequences. Storing prohibited items may result in immediate termination of services without refund. BoilerVault is not liable for any damage or loss caused by the storage of prohibited items. The Customer will also be responsible for any costs associated with the removal or disposal of such items.
The Customer’s items will be stored at a third-party storage facility selected at BoilerVault’s sole discretion. BoilerVault is not liable for any damage or loss that occurs at the third-party storage facility. BoilerVault reserves the right to refuse service for reasons including but not limited to non-compliance with these Terms and Conditions, failure to pay fees, or possession of prohibited items. BoilerVault may terminate Services at its sole discretion, and the Customer will not be entitled to a refund in such cases.
The Customer agrees to pay all fees associated with the Services, including storage fees, early retrieval fees, and any additional fees specified in these Terms. Payment must be made in full before the scheduled drop-off date. The Customer acknowledges that failure to pay will result in refusal of service. BoilerVault reserves the right to suspend Services until all outstanding fees are paid in full. Payment fees are non-negotiable and if not paid will result in termination of service immediately.
These Terms and Conditions are governed by the laws of the state in which BoilerVault operates. Any disputes arising from these Terms will be resolved in the courts of that state. The Customer agrees to submit to the jurisdiction of these courts and waives any objections to the venue or forum.
